Terms of Service
1. Acceptance of these terms
By creating an account or using startenderapp.com ("Startender", "the service") you agree to these Terms of Service. If you do not agree, do not use the service.
2. Eligibility
You must be at least 18 years old to use Startender. By signing up you confirm that you meet this requirement.
3. Service description
Startender is a marketplace that connects bartenders with venues. We are not a party to any employment contract, engagement, booking, or transaction between users. Any agreement to perform work, including rates, hours, and conditions, is solely between the bartender and the venue.
4. Your account and responsibilities
- You agree to provide accurate, current, and complete information about yourself and your venue or experience.
- You are responsible for keeping your account credentials secure. We recommend enabling two-factor authentication (TOTP-based) from your settings page; this is optional but materially increases account safety.
- You agree to behave professionally and respectfully in all communications on the platform.
- If you list a venue, you agree that we may verify the company number you provide against the UK Companies House public register. Public listing of your venue ("discoverable" mode) requires that this verification has succeeded.
4A. Direct venue payments
For direct-pay gigs, Startender is not the employer, payroll provider, or payment processor. Venues and bartenders are responsible for understanding and complying with applicable employment, payroll, tax, and National Insurance obligations. Where a venue is legally the employer or engager, the venue remains responsible for employer obligations.
4B. Card payments (venues)
Where the service allows you (as a venue) to save a payment method for future gig-related charges, card details are collected directly by Stripe via a Stripe-hosted form. Card numbers, CVV, and expiry are never transmitted through Startender's servers. Startender stores only the Stripe identifier of the saved payment method and a description (last 4 digits, brand, expiry month/year). Stripe's own terms apply to the card-data processing. We do not provide financial advice and do not act as a regulated financial institution.
5. Prohibited conduct
You agree not to:
- Spam, harass, threaten, or discriminate against other users.
- Create fake accounts, impersonate others, or misrepresent your identity, qualifications, or right to work.
- Use the service for any illegal activity, or to facilitate any illegal activity.
- Scrape, copy, or republish other users' profile content outside the platform.
- Use CVs or other personal data obtained through the service to build off-platform databases, to spam or harass users, or to contact them outside Startender without their permission or another lawful basis.
- Attempt to bypass security or rate-limiting controls.
6. Your content
You retain ownership of the content you upload (profile information, photos, CVs, videos, messages). By uploading, you grant Startender a non-exclusive, worldwide, royalty-free licence to host, store, display, and transmit that content for the purpose of operating the service.
6A. CV auto-import and AI-assisted suggestions
If you use Startender's CV auto-import feature, you authorise us to store the uploaded CV, extract text from it, and send a redacted version of that extracted text to service providers we use to generate draft profile suggestions. Before transmission, we strip email addresses, UK phone numbers, and address-style lines (see the Privacy Policy for technical detail). Those suggestions are assistive only and are provided for you to review and edit before they are applied to your profile. You remain responsible for checking that any information saved to your profile is accurate.
7. Termination
We may suspend or delete accounts that breach these terms, that we believe pose a risk to other users, or that have been inactive for an extended period. You may delete your account at any time from your settings.
8. Disclaimer of warranties
The service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted, error-free, or that any bartender or venue listed will be suitable for your needs.
9. Limitation of liability
To the fullest extent permitted by law, Startender will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or relating to your use of the service. Our total liability for any direct damages is limited to the greater of (a) the amount you have paid us in the past 12 months, or (b) £100.
10. Governing law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
11. Changes
We may update these terms from time to time. We will update the "Last updated" date and, where appropriate, notify you by email. Continued use of the service after changes means you accept the updated terms.
